Terms of service

Terms and Conditions (T&C)

of LIVE FAST DIE YOUNG Clothing GmbH for the purchase of merchandise through the online store at livefastdieyoung.com or the associated mobile app

Effective as of: September 27, 2026

§ 1 Scope

1. These General Terms and Conditions (“GTC”) apply to contracts that consumers enter into with LIVE FAST DIE YOUNG Clothing GmbH (hereinafter “LIVE FAST DIE YOUNG Clothing GmbH” or “we” or “us”) via the online store at livefastdieyoung.com or through the associated mobile app.

2. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity.

3. These Terms and Conditions apply exclusively to consumers.

4. These Terms and Conditions generally do not apply to the purchase of goods in brick-and-mortar stores. For contracts concluded there, the terms and conditions of the respective store, as effectively incorporated, apply.

5. The provisions in § 7 regarding gift cards also apply supplementarily to the redemption of LIVE FAST DIE YOUNG Clothing GmbH gift cards at LIVE FAST DIE YOUNG Clothing GmbH brick-and-mortar stores, provided that the respective gift card can be redeemed there.

§ 2 Contracting Party and Contact Information

1. The contracting party is:

LIVE FAST DIE YOUNG Clothing GmbH Schloßstraße 57 40477 Düsseldorf Germany

Phone: +49 211 361 89449 Email: support@livefastdieyoung.de

Court of Registration: Düsseldorf Local Court Commercial Register Number: HRB 69399

VAT ID No.: DE 287686637

Represented by the managing directors: Lorenz Amend, Alexander Pablo Steingass

2. The languages available for concluding the contract are displayed during the respective ordering process.

§ 3 Offer, Order, and Conclusion of Contract

1. The presentation of products and gift cards in the online store or in the mobile app does not generally constitute a legally binding offer, but rather an invitation to the customer to place an order. The customer may initially add products to the shopping cart without obligation and review and correct their entries using the correction options provided during the ordering process before submitting the order.

2. By clicking the final order button—which clearly indicates the obligation to pay—the customer submits a binding offer to enter into a contract for the products contained in the shopping cart.

3. Upon receipt of the order, the customer will receive an electronic confirmation of receipt of their order. A mere confirmation of receipt does not constitute acceptance of the contract offer unless its content expressly states that the order has been accepted.

4. For payment methods that involve only a payment authorization, reservation, or similar preliminary check, the contract is concluded as soon as we accept the customer’s offer by means of a separate order confirmation or ship the ordered goods, whichever occurs first.

5. For payment methods where we initiate the final charge to the selected payment method immediately after the order is placed, we accept the customer’s offer no later than upon sending the electronic confirmation to the customer regarding this or the acceptance of the order. The contract is concluded upon receipt of this confirmation of acceptance.

6. In the case of a gift card, the contract is concluded no later than upon provision of the gift card or the gift card code, unless the contract has already been concluded earlier in accordance with § 3, paragraph 4 or 5.

7. After the contract is concluded, we will send the customer the order details and these Terms and Conditions in the version valid at the time of the order via email. Registered customers can also view their order history through their customer account.

§ 4 Customer Account

1. A customer account may be offered for certain features of the online store or the mobile app.

2. The customer is obligated to provide accurate information upon registration and to update the customer account in the event of material changes.

3. Login credentials must be treated confidentially and adequately protected against unauthorized access by third parties.

4. There is no entitlement to the creation or ongoing technical availability of a customer account.

5. We may temporarily suspend a customer account if there are concrete indications of misuse, material breaches of contractual obligations, or unlawful use, and if the suspension is reasonable in light of the interests of both parties.

6. The customer will be informed of any suspension and its main reason, provided that this does not compromise security interests, investigations into misuse, or other legitimate interests.

7. The suspension or deletion of a customer account does not affect the customer’s existing rights arising from contracts already concluded. This applies in particular to claims arising from pending orders, statutory warranty rights, rights of withdrawal, and existing gift card balances.

8. The customer may request the deletion of their customer account. Statutory retention obligations and the data processing necessary for the fulfillment of existing contractual relationships remain unaffected.

9. Further information regarding the processing of personal data can be found in our Privacy Policy.

§ 5 Prices and Shipping Costs

1. The prices listed in the online store or in the mobile app at the time of the order apply.

2. Prices displayed to consumers are total prices and include the applicable statutory sales tax as well as other price components.

3. Additional shipping costs may apply. The amount of these costs will be displayed to the customer before they submit their binding order.

4. For deliveries to countries outside the European Union, additional customs duties, import taxes, or other public-law charges may apply. Unless these are collected by us or are expressly stated as included in the total price, the customer may be required to pay them to the relevant authorities or other agencies.

§ 6 Terms of Payment

1. The payment methods available for an order are displayed during the ordering process.

2. There is no entitlement to the availability of a specific payment method.

3. The availability of individual payment methods may depend, in particular, on the country of delivery, the order value, or the requirements and verifications of the respective payment service provider.

4. The purchase price is generally due upon conclusion of the contract, unless a different permissible due date is specified for the respective payment method during the ordering process.

5. For payment methods that involve only an authorization or reservation of the payment amount, this in itself does not constitute acceptance of the order.

6. If a gift card is used as a payment method, the credit applied will be applied toward the total order amount. Any remaining balance may be paid using another payment method offered at checkout.

7. Any additional terms and conditions of a payment service provider selected by the customer apply to the relationship between the customer and the respective payment service provider, provided they have been validly agreed upon.

§ 7 Gift Cards / Gift Certificates

7.1 Definition

1. Gift Cards as defined in these Terms and Conditions are vouchers issued by LIVE FAST DIE YOUNG Clothing GmbH that are purchased for a fee.

2. Discount codes, promotional vouchers, newsletter vouchers, and other discounts granted free of charge are not gift cards as defined in § 7; § 8 applies to these.

7.2 Redemption Conditions

1. Gift Cards issued by LIVE FAST DIE YOUNG Clothing GmbH may generally be redeemed via livefastdieyoung.com, via the associated mobile app, and in the German LFDY stores of LIVE FAST DIE YOUNG Clothing GmbH, provided that no different redemption terms are expressly specified at the time of purchase of the respective gift card.

2. The issuer of a gift card and the redemption terms will be clearly and comprehensibly communicated to the customer prior to purchase.

3. The redemption terms are also stated on the gift card, in the gift card email, or in direct connection with the gift card code, provided that this is possible given the specific design of the gift card.

4. Gift cards issued by other legally independent companies within the LFDY Group, in particular LFDY UK Limited, LFDY France SASU, or LFDY Netherlands B.V., are not gift cards issued by LIVE FAST DIE YOUNG Clothing GmbH. The respective obligations regarding the gift cards exist exclusively toward the company that issued the relevant gift card.

5. Gift cards issued by LFDY Netherlands B.V. for the LFDY Store Amsterdam or purchased there may be redeemed exclusively at the LFDY Store Amsterdam, unless otherwise expressly stated in the redemption terms and conditions at the time of purchase. Redemption in the German online store, the German mobile app, German LFDY stores, or at other companies within the LFDY Group is not permitted, unless expressly provided otherwise.

6. Gift cards issued by LFDY France SASU for the LFDY Store Paris or purchased there may be redeemed exclusively at the LFDY Store Paris, unless otherwise expressly stated in the redemption terms and conditions at the time of purchase. Redemption in the German online store, the German mobile app, German LFDY stores, or at other companies within the LFDY Group is not permitted, unless expressly provided otherwise.

7. Gift Cards issued by LFDY UK Limited may be redeemed exclusively within the United Kingdom distribution system operated by LFDY UK Limited. This includes, to the extent applicable to the respective gift card, in particular the UK online store operated by LFDY UK Limited, the associated UK mobile app, and participating LFDY stores in the United Kingdom. Redemption at LIVE FAST DIE YOUNG Clothing GmbH or at other legally independent companies within the LFDY Group is not permitted, unless expressly provided otherwise.

8. For gift cards issued by other companies, the terms and conditions of the respective issuing company apply. Redemption across companies is permitted only if this is expressly provided for the gift card in question.

7.3 Validity and Statute of Limitations

1. Claims arising from gift cards purchased for a fee are subject to the statutory limitation periods.

2. Gift cards may generally be redeemed until the statutory limitation period expires.

3. The standard statutory limitation period is three years and generally begins at the end of the year in which the claim arose and the other statutory requirements for the commencement of the limitation period are met.

4. Any expressly granted longer redemption period remains unaffected by this provision.

7.4 Partial Redemption and Remaining Balance

1. Gift Cards may be redeemed in full or in part within the limits of the available balance.

2. Any balance remaining after a partial redemption remains on the gift card and can continue to be used until the statute of limitations expires.

3. If the gift card balance is insufficient for a purchase, the remaining amount may be paid using a payment method offered by the respective sales channel.

4. Multiple gift cards may be used for the same order, provided that this option is technically available through the respective sales channel.

7.5 Cash Redemption

1. A cash refund of the face value or any remaining gift card balance is generally not required.

2. Statutory claims for refunds or rescission remain unaffected by this provision.

7.6 Transferability, Loss, and Voucher Codes

1. Gift cards are generally transferable, provided they were not expressly designated as personal at the time of purchase.

2. Gift card codes must be protected from unauthorized access by third parties.

3. In the event of loss of a gift card or suspicion of unauthorized use, the customer must contact us immediately.

4. If a gift card can be clearly identified, has not yet been fully redeemed, and can be technically blocked, we may, after a reasonable review, block the card and, if necessary, issue a replacement.

5. The customer’s further legal claims remain unaffected.

7.7 Refunds for Orders Paid for with a Gift Card

1. If there is a legal right to a refund of the purchase price, the refund will generally be issued using the same payment method originally used.

2. The portion paid with a gift card will generally be credited back to the gift card balance used.

3. If a chargeback to the original gift card is technically impossible, a corresponding replacement credit will be provided. The redemption period applicable to the replacement credit may not be shorter than the remaining redemption period for the credit being refunded.

4. Any portion of the payment made using a different payment method will generally be refunded to that payment method.

5. The customer will not incur any additional fees as a result of the refund.

6. If, as part of a voluntary returns program, we alternatively offer a full or partial refund in the form of a gift card, this will only occur based on the customer’s express decision. Statutory refund claims remain unaffected.

7.8 Right of Withdrawal When Purchasing a Gift Card

1. When purchasing a gift card through the online store or the mobile app, statutory consumer rights—including the statutory right of withdrawal—apply unless a statutory exception applies.

2. For digitally provided gift cards, the mere electronic provision of the gift card or the gift card code does not result in the loss of an existing right of withdrawal.

3. If the customer has already redeemed the gift card in whole or in part before exercising the right of withdrawal, the benefits already received through the gift card will be taken into account during the reversal of the transaction in accordance with statutory provisions.

4. The customer will receive the cancellation information required for the specific gift card purchase before the contract is concluded.

§ 8 Discount Codes and Promotional Coupons

1. Discount codes and promotional coupons grant a price reduction in accordance with the terms and conditions announced for the respective promotion. They do not represent a monetary value acquired in exchange for payment.

2. In particular, the promotional period, minimum order value, excluded products, any restrictions to specific customers, single-use limitations, and other requirements are specified in the respective promotional terms and conditions.

3. Discount codes cannot be used to purchase gift cards, unless expressly stated otherwise in the respective promotion.

4. Personalized discount codes may only be used by the person or through the customer account for whom the code was issued.

5. Discount codes may be combined with gift cards as a payment method.

6. Multiple discount codes may only be combined for the same order if this is provided for in the respective promotional terms and conditions or is expressly permitted at checkout.

7. In the event of a return, discounts applied to returned items will be taken into account when calculating the refund amount, based on the original price calculation.

8. If a discount was expressly contingent on certain conditions, such as a minimum order value, the discount may be voided or recalculated as a result of a partial return only if the corresponding consequences were clearly and comprehensibly communicated to the customer in the promotional terms and conditions prior to the conclusion of the contract and the provision is legally permissible.

9. A technical error in the application of a discount code does not constitute a general right to unilaterally increase a purchase price that has already been validly agreed upon. The statutory provisions apply, in particular those regarding error and rescission.

10. If a discount code is used in a manner contrary to the promotional terms and conditions communicated prior to the conclusion of the contract, we may refuse its application before the contract is concluded. After the contract is concluded, our rights are governed by the agreements made and the statutory provisions.

§ 9 Delivery and Delivery Times

1.Delivery is made to the shipping address provided by the customer during the ordering process within the countries to which delivery is offered.

2. The delivery time applicable to the respective order will be communicated to the customer before the customer submits a binding order.

3. For sales, limited-edition drops, or special promotions, the different delivery times specifically displayed to the customer at checkout before the order is placed shall apply.

4. If an ordered item is unavailable after the contract is concluded because our supplier fails to deliver to us—through no fault of our own and despite the supplier’s contractual obligation—we are entitled to rescind the contract. In this case, we will immediately inform the customer of the item’s unavailability.

5. Any payments already received for goods that will ultimately not be delivered will be refunded immediately, provided there is no other claim to the payment.

6. Partial deliveries are permitted if they are reasonable for the customer. The customer will not incur additional shipping costs as a result of a partial delivery arranged by us.

7. The risk of accidental loss or accidental deterioration of the goods passes to the consumer in accordance with statutory provisions.

8. To the extent that environmentally friendly delivery options are available for an order, these will be disclosed to the customer prior to the conclusion of the contract in accordance with statutory disclosure requirements.

§ 10 Retention of Title

The delivered goods remain our property until the purchase price owed for them has been paid in full.

§ 11 Right of Withdrawal and Returns

1. Consumers generally have the statutory right of withdrawal for distance sales contracts, provided that no statutory grounds for exclusion or expiration apply.

2. For goods, the cancellation policy in Appendix 1 applies.

3. For gift cards, § 7.8 and the cancellation information provided for the specific gift card purchase apply in addition.

4. The statutory right of withdrawal may be exercised by any legally permissible means. For distance sales contracts concluded via our online user interface and for which a statutory right of withdrawal applies, we additionally provide an electronic withdrawal function in accordance with § 356a of the German Civil Code (BGB) during the statutory withdrawal period.

5. The electronic cancellation function is permanently available on the respective online user interface throughout the cancellation period; it is prominently displayed and easily accessible. The function is labeled “Cancel Contract” or another equally clear and unambiguous phrase. After providing or confirming the information required by law, the customer can submit the notice of withdrawal via a confirmation button labeled “Confirm Withdrawal” or another equally clear and unambiguous phrase. Upon submission, we will immediately send a confirmation of receipt on a durable medium that includes at least the content of the notice of withdrawal as well as the date and time of its receipt.

6. For goods purchased via livefastdieyoung.com or the associated mobile app, we provide an online returns portal for processing returns. Use of the returns portal is not a prerequisite for the effective exercise of the statutory right of withdrawal. Statutory notices of withdrawal may be submitted by any legally permissible means.

7. If the goods are returned under the statutory right of withdrawal and show a loss in value, we are entitled to deduct compensation for the loss in value from the refund amount (Section 357a(1) of the German Civil Code (BGB)). A loss in value exists, in particular, if the goods have been handled beyond what is necessary to examine their nature, characteristics, and functionality. For shoes, the following applies: The extent necessary for examination includes a brief try-on on a clean indoor surface. Actual wear in everyday life, outdoors, or on surfaces that leave visible scuff marks on the outsole, exceeds this necessary extent and gives rise to an obligation to pay compensation for the loss in value. The same applies to the removal of labels, tags, or security tags, as well as to other signs of use that go beyond a typical try-on.

8. Voluntary returns or exchanges of goods purchased online are handled exclusively through the online sales channel or the designated returns process. Returns or exchanges of goods purchased online are not permitted at LFDY brick-and-mortar stores, unless we expressly offer otherwise in individual cases. Statutory rights of withdrawal and rights arising from defects remain unaffected by this provision.

9. There is no general statutory right of withdrawal or return for goods purchased at a physical LFDY store. A voluntary return or exchange will only be granted if this has been expressly offered or agreed upon at the respective store. In all other respects, only the customer’s statutory rights apply, in particular the statutory rights regarding defects. Goods purchased in-store can generally only be processed through the respective brick-and-mortar store; returns or exchanges via the online store or the online returns portal are not permitted, unless we expressly offer otherwise in individual cases.

10. Statutory grounds for the exclusion or expiration of the right of withdrawal remain unaffected. Whether such a ground for exclusion or expiration exists depends exclusively on the statutory requirements in the specific individual case.

§ 12 Statutory Rights Regarding Defects and Warranties

1. The statutory rights regarding defects apply without restriction to the goods we sell.

2. An additional commercial warranty applies only if it is expressly granted for the product in question.

3. A commercial warranty does not limit the customer’s statutory rights regarding defects.

§ 13 Liability

1. We are fully liable for damages resulting from an intentional or grossly negligent breach of duty.

2. We are also liable without limitation for damages resulting from a culpable injury to life, limb, or health.

3. Liability under the Product Liability Act, as well as liability arising from a warranty expressly assumed by us or in the event of fraudulent concealment of a defect, remains unaffected.

4. In the event of a breach of a material contractual obligation due to slight negligence, our liability is limited to damages typical for this type of contract and foreseeable at the time the contract was concluded.

5. Essential contractual obligations are those obligations whose fulfillment is essential for the proper performance of the contract and on whose compliance the customer may regularly rely.

6. In all other respects, liability for breaches of duty resulting from slight negligence is excluded.

7. The foregoing liability provisions apply mutatis mutandis in favor of our legal representatives, employees, and vicarious agents.

§ 14 Consumer Dispute Resolution

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 15 Governing Law

1. The law of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

2. This choice of law applies only to the extent that it does not deprive the customer of the protection afforded by mandatory provisions of the law of the country in which the customer has his or her habitual residence.

§ 16 Severability Clause

Should one or more provisions of these General Terms and Conditions be or become wholly or partially invalid or unenforceable, or should these General Terms and Conditions contain a loophole, the validity of the remaining provisions of these General Terms and Conditions shall remain unaffected. The invalid or unenforceable provision shall be replaced, where applicable, by the relevant statutory provisions.

Appendix 1 – Notice of Right of Withdrawal

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

For a contract concerning a single item, the withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the item.

If you have ordered multiple items as part of a single order that are delivered separately, the withdrawal period begins on the day on which you or a third party designated by you—who is not the carrier—took possession of the last item.

If an item is delivered in multiple partial shipments or pieces, the cancellation period begins on the day on which you or a third party designated by you, who is not the carrier, took possession of the last partial shipment or the last piece.

To exercise your right of withdrawal, you must notify us

LIVE FAST DIE YOUNG Clothing GmbH Schloßstraße 57 40477 Düsseldorf Germany
Phone: +49 211 361 89449 Email: support@livefastdieyoung.de

by means of a clear statement—for example, a letter sent by mail or an email—informing us of your decision to withdraw from this contract.

You may use the attached sample withdrawal form for this purpose; however, this is not required.

You may also exercise your right of withdrawal online using the “Withdraw from Contract” feature provided on the livefastdieyoung.com website or, where applicable, via the corresponding withdrawal feature within the mobile app. If you use this online function, we will immediately send you a confirmation of receipt on a durable medium (e.g., via email) containing information about the content of the notice of withdrawal as well as the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send the notice exercising your right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments received from you, including delivery costs. This excludes any additional costs incurred because you chose a different type of delivery than the least expensive standard delivery option we offer.

The refund will be issued immediately and no later than fourteen days from the day we receive your notice of withdrawal.

We will generally use the same payment method you used for the original transaction for the refund, unless otherwise expressly agreed. You will not incur any fees as a result of the refund.

We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.

You must return or hand over the goods to the following return address without delay and no later than fourteen days from the date on which you notify us of the cancellation:

LIVE FAST DIE YOUNG Clothing GmbH Königsberger Str. 100 (Halle D10) 40231 Düsseldorf Germany

The deadline is met if you ship the goods before the fourteen-day period expires.

You are responsible for the direct costs of returning the goods, unless we expressly offer you a more favorable arrangement.

You are only liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that was not necessary for inspecting their nature, characteristics, and functionality.
